Ripped off by Fincas Eva the real estate agent in Barcelona
Fincas Eva (www.fincaseva.com) and their international real estate agents (e.g.: Daniela Gnecchi daniela@***.com) are fraudsters. They advertise relatively inexpensive luxury apartments for sale in Barcelona, take a reservation payment of Euros 3000 and you never see your money back as well as you never buy any apartments. We paid them a reservation fee and our lawyer performed a due diligence of the apartment. It appears that apartment is comprised from 2 different apartments. Fincas Eva knew this information and hide it on purpose. We requested reservation payment back because we didi not have any intentions to purchase apartment that is registered as 2 apartments. Never got payment back, Fincas Eva stopped respond to our emails and phone calls.

Mr. Samuel Berestizhevsky paid 3,000€ to reserve a property in Barcelona, as required by law.
During the due diligence it emerged that the property was registered as two separate units because in the past it had been split into two different apartments and then it had been joint again. This is quite usual in Barcelona, especially in large flats in the Eixample area.
This was unknown to Ms. Daniela Gnecchi who was following the operation at the moment of the reservation.
However, FAR FROM BEING A PROBLEM, this is actually a big advantage in Barcelona. Obtaining permission to split properties has now become more difficult and having the opportunity to split the flat into two separate units without having to ask for an authorization is something that investors value a lot.
It is much easier and it ensures a higher return to resell or to rent out two smaller properties than a large one (total surface of the unit was around 200 m2). So the existing state of the registration was an added value for the property.
Additionally, it was possible to change the registration very easily with a simple signature of a document in front of a notary. It could have been done the same day of the signature of the purchase deeds. The property could have been registered again as one only unit in a matter of minutes.
All this was explained several times to Mr.
Berestizhevsky by the agency and by his lawyers.
However, he refused to go on with the sale. BY LAW, the fact that the property was registered as two separate units did not represent a valid reason to cancel the sale (because it was an advantage and it could have been changed WITHOUT ANY PROBLEM). Therefore Mr. berestizhevsky had no right whatsoever in front of the law to ask for his money back after the owner of the property had kept it reserved for weeks for Mr.
berestizhevsky and had lost other possible visits and consequently possible sales to other more serious investors. The case is simply that mr. berestizhevsky backed off from the sale with no reason and this implies, according to the Catalan law, the loss of the reservation deposit. mr.
berestizhevsky had simply changed his mind and tried to use the non-existing issue of the registration as an excuse to cover his behaviour. This is not admissable by the Catalan law. And insulting people who are doing their job according to the law only shows what type of person mr.
berestizhevsky is.
Fincas Eva pretends to be a real estate professional without knowing a basic real estate law 1+1 = 2.5. When you buy one apartment that comprises from 2 different apartments the living area gets bigger because of use of dormant space of each of apartments.
This means you pay for higher living area when officially you have a smaller one. This is a rip off. A customer should know upfront that apartment is actually registered as 2 separate apartment and as a matter of fact Fincas Eva knew this information and hid it on purpose. This constitutes criminal intentions by any law in any normal country including Spain.
Not returning deposit fee to a customer when problem was revealed by the customer is a straight forward act of stealing money from the customer.
Run away from Fincas Eva if you ever meet them. They are not professional real estate agents and they only know how to rip off customers and steal their deposits.
